Terms of Service

1. Preamble

These Terms of Service ("Terms") govern the use of the TourMate mobile application ("the App"), published by TourMate SAS, a simplified joint-stock company registered with the Paris Trade and Companies Register, headquartered in France.

2. Purpose

TourMate is a mobile application designed for tour guides, travel agencies, and travel professionals ("Guides") to facilitate the organisation of trips with their clients. The App allows you to create trips, invite clients, plan itineraries and maps, communicate via a built-in chat, and securely share documents and trip information.

3. Access to the App

The App is available free of charge on iOS (App Store) and Android (Google Play Store). Using the App requires creating a user account with an email address or a third-party account (Google, Apple).

4. Free and paid features

The core features of TourMate are provided free of charge. TourMate reserves the right to introduce premium features or paid subscriptions in the future. Pricing terms and conditions of access will be specified in an addendum to these Terms at that time.

5. User obligations

By using the App, you agree to:

  • provide accurate information when creating your account;
  • not use the App for any illegal or fraudulent purpose;
  • not disrupt or interfere with the operation of the App;
  • respect other users' rights and not share unlawful or defamatory content.

6. Liability

TourMate takes all necessary measures to ensure the availability and security of the App. However, TourMate cannot be held liable in cases of force majeure, scheduled maintenance, or telecommunications network failures.

TourMate is not responsible for disputes between Guides and their clients relating to the organisation of a trip. The Guide remains solely responsible for the content of itineraries, information transmitted, and the commercial relationship with their clients.

TourMate acts as a technical tool for coordination and organisation only. It is not a party to any commercial transaction between the Guide and their clients.

7. Intellectual property

All elements of the App (source code, design, logos, text, images) are the exclusive property of TourMate SAS and are protected by applicable intellectual property laws. Any unauthorised reproduction, representation, or use is strictly prohibited.

8. Personal data

Users' personal data is collected and processed in accordance with the General Data Protection Regulation (GDPR). For more information, please refer to our Privacy Policy.

9. Changes to these Terms

TourMate reserves the right to modify these Terms at any time. Users will be informed of significant changes via the App or by email. Continued use of the App after a modification constitutes acceptance of the updated Terms.

10. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties will first attempt to reach an amicable resolution. Failing that, the competent courts shall be those in the jurisdiction of TourMate SAS's registered office.
